PRIVACY POLICY

This Privacy Policy has been developed in accordance with the regulations of the European Union and the Rules of Use of the Site https://imennails.eu/.

The Privacy Policy (hereinafter referred to as the Policy) is an appendix to the Rules of Use of the Site and an integral part of them. By accepting the terms of the Site's Terms of Use, the User automatically accepts the terms of this Policy.

1. Terms and definitions

• The Parties are the Site Administration (Amelisa OÜ, Registry code: 16487978, VAT EE102720877, Registered address: Harju maakond, Tallinn, Kesklinna linnaosa, Vesivärava tn 50-201, 10152, Estonia) and any User of the Site.

• Transmitting party (disclosing) – a Party providing the other Party with access to Confidential Information of which it is the owner, including by transmitting Confidential Information on tangible or electronic media or via the Internet.

• Receiving party – a Party that receives access from another Party to Confidential Information.

• Confidential information – information recognized as confidential in accordance with EU legislation, local regulations of the Transmitting Party, contractual obligations, including commercial secrets and personal data.

• Confidentiality of information – a mandatory requirement not to transfer Confidential Information to third parties without the prior written consent of its owner.

• Information carriers – material objects in which Confidential Information is displayed in the form of symbols, technical solutions and processes.

• Transfer of Confidential Information – transfer of confidential information on tangible or electronic media, or via the Internet, while maintaining confidentiality.

• Disclosure of Confidential Information – any action or omission resulting in Confidential Information becoming known to third parties without proper consent.

2. General provisions

2.1. The Parties agree to consider all information exchanged while using the Site, registering, accessing and using its functionality as Confidential Information, to the extent permitted by EU legislation.

2.2. Within this Policy, each Party may act as both a Receiving and a Transmitting Party.

2.3. The provisions of this Policy apply regardless of the type of media on which Confidential Information is recorded.

2.4. Information provided without transferring tangible media and contained in digital resources is considered Confidential Information without additional marking.

2.5. Access to Confidential Information is provided only through secure communication channels.

2.6. The transfer and processing of personal data is carried out in accordance with Regulation (EU) 2016/679 (GDPR), this Policy and applicable EU data protection laws.

3. Obligations

3.1. The Receiving Party must not disclose Confidential Information without express permission and must take reasonable measures to protect it.

3.2. Confidentiality obligations do not apply to information that:

  • is publicly known without fault of the Receiving Party;
  • is obtained from public sources without confidentiality obligations;
  • must be disclosed in accordance with applicable law.

3.3. The Administration applies technical, organizational and legal measures to protect Confidential Information and Users’ personal data from unlawful access or disclosure.

3.4. The Site Administration may aggregate and analyze information to create analytical reports and databases, while guaranteeing confidentiality.

3.5. The Receiving Party undertakes to:

  • use Confidential Information solely for the purposes of using the Site;
  • limit access to Confidential Information to authorized employees only.

3.6. The Receiving Party must maintain confidentiality and ensure protection of Confidential Information at a level not lower than that used for its own confidential data.

The Receiving Party independently determines the methods of protecting Confidential Information.

4. Responsibility and dispute resolution

4.1. For each violation of this Policy, the Receiving Party compensates documented actual damages in full.

4.2. Disputes arising from this Policy shall be resolved through negotiations, and if unresolved, in court in accordance with the Terms of Use of the Site.

5. Validity period and final provisions

5.1. This Policy enters into force from the moment the User accepts the Rules of Use of the Site.

If the User does not agree with this Policy, they must stop using the Site.

5.2. Termination of Site use does not release the Parties from obligations regarding Confidential Information received prior to termination.

5.3. Confidentiality obligations remain in force for three (3) years from the date of transfer of Confidential Information.
